PLEASE READ THIS. IT CONSTITUTES PART OF YOUR CONTRACT FOR YOUR TRIP

AND ANY RELATED SERVICES. PLEASE LET US KNOW IF YOU HAVE ANY QUESTIONS.

Travel with Wendy B, LLC is herein referred to as “TRAVEL WITH WENDY B”, “We”,

“Us”, and “Our”. Booking Passenger is herein referred to as “Booking Passenger”,

“Passenger”, “Traveler”, “You” and “Your”.

CONTRACT. We draw Your attention to the terms and conditions of travel below,

including all brochures, documents, correspondence, Privacy Policy, and the terms

and conditions of our suppliers and form the basis of the contract with you

(collectively “Terms and Conditions”). Before making a booking with Us you must

ensure that you have read and understood these Terms and Conditions (raising any

questions you may have with Us). Please be aware that these Terms and

Conditions contain waivers of liability as well as waiver of class action and

venue selection and notice clauses. By asking Us to confirm Your booking or

making any payment to US, You are accepting all of the Terms and Conditions laid

out herein and acknowledge that you have read the terms of this contract and

agree with them.

You, as the Booking Passenger(s) will be the only recipient of the booking receipt,

invoice and terms and conditions. It is Your sole responsibility as the Booking

Passenger(s) to inform all other passengers traveling with You or sharing the room

with You of the contents of these Terms and Conditions prior to booking with Us.

The Booking Passenger(s), by accepting this receipt and making payment to TRAVEL

WITH WENDY B, acknowledges that the passengers have been advised of, reviewed,

and hereby accept these Terms and Conditions and contract for travel related

services and are financially responsible for the booking(s). TRAVEL WITH WENDY B

will not be liable for your failure to share these Terms and Conditions with all

travelers or passengers in your group.

You represent and warrant that (a) You are of sufficient age to use our services and

website, (b) You can create binding legal obligations in connection with Your use, (c)

You are legally authorized to act on behalf of those you represent, (d) You accept

these Terms and Conditions on their behalf (in addition to Your own), and (e) the

information supplied by You or members of Your travel party is true and correct.

CHANGES TO THESE TERMS AND CONDITIONS. TRAVEL WITH WENDY B reserves

the right, at our sole discretion, to change the Terms and Conditions at any time.

You acknowledge and agree that We may change these Terms and Conditions from

time to time and that those changes become effective immediately. You agree to be

bound by the Terms and Conditions that are in effect at the time of Your travel or

cancellation, whichever applies. If We make material changes the impact Your

booking(s) with Us, We will notify You. You agree that it is Your responsibility to be

familiar with these Terms and Conditions and to check back from time to time for

any changes. Your continued use of our services, including continuing to use or

maintain any booking(s) after changes to the Terms and Conditions constitutes

Your consent to the changes.

COVID 19 RELEASE OF LIABILITY. By booking travel at this time, you acknowledge

the highly contagious nature of COVID-19 and voluntarily assume the risk for

yourself and any minors traveling with you, that you or they may be exposed to or

infected by COVID-19 by traveling and that such exposure or infection may result in

personal injury, illness, permanent disability, and death, even if such injuries or

losses occur in a manner that is not foreseeable at the time you book Your tour.

You acknowledge that exposure to such viruses or disease is an inherent risk of

traveling, which cannot be controlled or eliminated by TRAVEL WITH WENDY B.

You acknowledge that due to the uncertainty of travel at this time, Your tour may

be postponed or cancelled, or changes may be made to itineraries due to closures

of certain sites or activities, for which there may be no refund. You may also be

required to quarantine upon arrival in some locations. Some locations may require

you to have a vaccination or proof of a negative test. You must also meet the

requirements of any stopover countries. Upon returning home there may be

additional requirements. You are responsible for understanding these

requirements and must not rely on TRAVEL WITH WENDY B to provide these details.

You understand that you may become sick before, during, or after the tour and

may not be able to travel and such cancellation or interruption will be subject to

our cancellation terms below, for which We will not be liable.

You agree that due to uncertainty caused by COVID-19, TRAVEL WITH WENDY B has

strongly encouraged the purchase of travel protection coverage including cancel for

any reason coverage if and when available, and that should you fail to purchase

travel protection coverage, Travel with Wendy B shall not be liable to you for any

losses howsoever arising. You assume the risk that travel insurance may not cover

COVID-19 related claims.YOU, FOR YOURSELF, AND ANY MINORS TRAVELING WITH YOU,

AND ON BEHALF OF

YOUR AND THEIR HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN

(THE RELEASORS), HEREBY RELEASE, AND HOLD HARMLESS LLC, ITS MEMBERS,

OWNERS, AGENTS, AND/OR EMPLOYEES, SUPPLIERS, AND OTHER TOUR MEMBERS

(RELEASEES), OF, FROM, AND AGAINST ANY AND ALL CLAIMS, DAMAGES, DEMANDS,

LOSSES, AND LIABILITY ARISING OUT OF OR RELATED IN ANY WAY, IN WHOLE OR IN

PART TO ANY POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY,

DEATH, OR ANY OTHER LOSS YOU MAY SUFFER DUE TO EXPOSURE, INFECTION,

SPREAD, CLOSURE, AND TRAVEL RESTRICTIONS RELATED TO COVID- 19, WHETHER

ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, TO THE

FULLEST EXTENT PERMITTED BY LAW. THE TERMS OF THIS HOLD HARMLESS AND

RELEASE OF ALL LIABILITY PARAGRAPH, SHALL SURVIVE ANY TERMINATION OR

CANCELLATION OF THIS CONTRACT, WHETHER BY OPERATION OF LAW OR

OTHERWISE.

SCOPE & ROLE OF AGENCY. TRAVEL WITH WENDY B, LLC does not provide, own,

manage, operate, supervise, or control the travel services and products that are or

may be provided as part of Your trip, such as flights, accommodations, cruises,

tours and excursions, rental cars, packages, or travel insurance (the “Travel

Products”). All Travel Products are subject to any, and all applicable laws,

regulations, and tariffs and are owned, controlled, operated, or made available by

vetted, independent third parties, such as destination management companies,

airlines, hotels, cruise lines, and tour operators (the “Supplier(s)”). The Suppliers are

solely responsible for the Travel Products as well as any and all benefits, perks, or

amenities, including without limitation, resort credits, on-board credits, free

specialty dining, spa credits, in-room amenities, etc. The Supplier’s terms,

conditions and privacy policies apply to Your booking, so by booking with Us you

agree to and understand all Supplier’s terms and conditions and privacy policies.

Your interaction with any Supplier is at Your own risk; TRAVEL WITH WENDY B does

not bear any responsibility should anything go wrong with Your booking or during

Your travel.

AS THE TRAVELER YOU AGREE THAT TRAVEL WITH WENDY B ACTS ONLY AS AGENT

FOR THE TRAVELER IN ACQUIRING TRANSPORTATION, HOTEL ACCOMMODATIONS,

CRUISES, SIGHTSEEING AND OTHER TRAVEL PRODUCTS, PRIVILEGES OR SERVICES

FOR THE TRAVELER’S BENEFIT, AND ON THE EXPRESS CONDITION THAT TRAVEL

WITH WENDY B SHALL NOT BE RESPONSIBLE FOR ANY ACT, OMISSION,

NEGLIGENCE, BANKRUPTCY, INSOLVENCY OR DEFAULT OF ANY SUPPLIER,

COMPANY OR PERSON ENGAGED IN OR RESPONSIBLE FOR ANY TRAVEL PRODUCTS,

OR OTHERWISE IN CONNECTION THEREWITH. TRAVELER FURTHER AGREES THAT

TRAVEL WITH WENDY B SHALL NOT BE LIABLE FOR ANY INJURY TO PERSON OR

PROPERTY, OR ANY OTHER LIABILITY WHETHER BASED IN CONTRACT, TORT, STRICT

LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY

DIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, DIRECT, OR INCIDENTAL DAMAGES

IN CONNECTION WITH THE TRAVEL PRODUCTS OR SERVICES BOOKED WITH ANY

SUPPLIER THROUGH TRAVEL WITH WENDY B. TRAVEL WITH WENDY B SHALL NOT

BE LIABLE FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, OR DELAY

WHICH MAY OCCUR DUE TO THE FAULT, WILLFUL ACTS OR OMISSIONS,

NEGLIGENCE OR OTHERWISE OF ANY SUPPLIER AND/OR ITS RESPECTIVE

EMPLOYEES, CONTRACTORS, MANAGERS, OWNERS, AGENTS, OR OPERATORS.

PASSPORTS. Everyone, including children and infants, must have a valid passport

book to travel internationally (not the Passport Card). Failure to comply will result in

denial of boarding, no refund, no exceptions. TRAVEL WITH WENDY B is not

responsible for passports in any way. Passports are required to be valid for at least

six (6) months from Your return date. Many countries require that Your passport

has at least two completely blank pages to be valid. Please take a moment now to

check on Your passport validity. If Your passport expires within six (6) months of

Your flight home, or if it does not have enough blank pages, please be sure to get it

renewed before Your trip to avoid being denied boarding. The rates We provide are

for passengers carrying a US passport. Hotels reserve the right to change the rates

for passengers booking a US rate but checking in with a non-US passport. Citizens

of other countries require a valid passport and may also require additional

documents. Such persons should contact consulates of countries to be visited and

obtain proper documents before departure. The possession of required and valid

passport and visas is the sole responsibility of the passenger(s). Air travelers with

identification (ID) that does not meet the REAL ID ACT requirements will have to use

alternate ID forms (passport, military ID, or permanent resident card) to pass TSA

security checkpoints—even for domestic travel. Please visit www.travel.state.gov or

https://www.dhs.gov/real-id for the most updated requirements for travel

documentation. Visas are required when they apply. Travelers voluntarily assume

full and sole responsibility for any and all risks and/or costs involved with failure to

report any errors and/or omissions to documentation.

TRAVEL DOCUMENTS & REQUIRMENTS FOR FOREIGN ENTRY. Passenger(s)

assumes sole responsibility to independently confirm all documentation

requirements for all passport, visa, inoculations, or other entry and/or travel

requirements of each destination. Passenger(s) assumes sole responsibility for, and

hereby releases TRAVEL WITH WENDY B from any claims or responsibility for any

and all damages incurred as a result of Passenger’s failure to comply with

applicable documentation requirements, including but not limited the requirement

that all Passengers procure, and have on their person the proper travel documents

at all times. TRAVEL WITH WENDY B recommends the Passengers consult with the

appropriate domestic and foreign governmental agencies for the current document

requirements. By agreeing to TRAVEL WITH WENDY B Terms & Conditions, you are

authorizing TRAVEL WITH WENDY B and its agents to accept the passenger contract

and all terms associated with Your reservation as received by TRAVEL WITH WENDY

B. It is Your sole responsibility to secure and/or pay for any, and all visas, reciprocity

fees, affidavits, immunizations, etc. that are required to be permitted entry into

each destination. In some countries you may be subject to entry (reciprocity) fees

and/or departure taxes/ exit fees which will be collected at the airports upon

entry/departure by local government authorities. Please note that entry to any

country may be refused even if the required information and travel documents are

complete or if Passenger(s) have a criminal history, even if expunged. Please inform

Us prior to booking with Us if this applies to You and seek separate legal counsel to

confirm Your ability to travel to your desired destination. TRAVEL WITH WENDY B is

not responsible or liable to You for any losses, expenses, or refunds to You, or

anyone on Your booking(s) for you being refused or denied entry in any way.

The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S.

Government to U.S. citizens who are traveling to, or living in, a foreign country.

STEP allows you to enter information about your upcoming trip abroad so that the

Department of State can better assist you in an emergency. Registration is

recommended and provided by going to https://step.state.gov/step/. Further,

certain countries restrict travelers with criminal convictions, even if expunged.

Please inform us prior to booking with us if this applies to you and seek separate

legal counsel to confirm your ability to travel to your desired destination. If you are

denied access to a country or a Supplier due to a conviction, TRAVEL WITH WENDY

B shall not be liable for any losses, expenses, or refunds to you or anyone in your

group.

Recommended inoculations for travel may change and You should consult with

your medical practitioner for current recommendations before You depart. It is

Your sole responsibility to ensure the You meet all health entry requirements,

obtain the recommended inoculations, take all recommended medication(s), and

follow all medical advice in relation to Your travel. Inoculation requirements can be

found on the Center for Disease Control website at: http://www.cdc.gov.

Air travelers with identification (ID) that does not meet the REAL ID ACT

requirements will have to use alternate ID forms (passport, military ID, or

permanent resident card) to pass Transportation Security Administration (“TSA”)

security checkpoints—even for domestic travel. Please visit www.travel.state.gov or

https://www.tsa.gov/traveler-information/acceptable-ids for the most updated

requirements for travel documentation. Visas are required when they apply. U.S.

citizens traveling to the United Kingdom (UK) for short visits, tourism, or business,

including those just passing through UK airports, will need an Electronic Travel

Authorization (ETA) if they do not have a UK visa or legal residency in the UK or the

Republic of Ireland. You can find out if your international destination requires a visa

and how to apply at https://www.usa.gov/visas-citizens-traveling-abroad. Travelers

voluntarily assume full and sole responsibility for any and all risks and/or costs

involved with failure to report any errors and/or omissions to documentation.

You acknowledge any failure to strictly comply with these requirements may result

in denied boarding, or an undue delay at an airport security checkpoint causing You

or another passenger traveling with you to miss flight(s), and subsequent scheduled

travel bookings. TRAVEL WITH WENDY B bears no responsibility for advising and/or

obtaining required travel documentation for You, or for any delays, damages,

and/or losses, including missed portions of Your travel plans related to improper

documentation or government decisions about entry.

BOOKING ACCURACY/LEGAL NAMES.: Passenger(s) is required to verify the

accuracy of each legal passport first, middle & last names and date of birth listed on

the invoice and travel documents. It is mandatory that passenger names be

identical to the names as they appear on passports, booking and travel documents.

Penalties associated with name changes are the sole responsibility of the

passenger(s). Passenger(s) is required to immediately review all aspects of their

booking to verify (but not limited to): passenger names, mailing address, email

address, telephone number, date of birth, pricing, airfare, arrival/departure

airports, accommodations, and organized activities on Your booking receipt. Please

review Your booking confirmation thoroughly and notify TRAVEL WITH WENDY B

within 24 hours of deposit if any omissions and/or corrections are needed

regarding the booking details. Passenger(s) voluntarily assumes full & sole

responsibility for any, and all risks and/or costs involved with failure to report such

errors and/or omissions within 24 hours of booking.

PAYMENTS. Planning travel takes hours of preparation and work, well in advance

of Your departure date. As travel planning professionals, TRAVEL WITH WENDY B

charges a planning fee for the work We do to plan Your trip. This planning fee is

always non-refundable and is due before We begin planning Your trip. Many

Suppliers require payment at or near the time of booking. We therefore require a

deposit to book Your reservation. TRAVEL WITH WENDY B may hold reservations

until the deposit due date. If deposit/payment is not received by TRAVEL WITH

WENDY B on or before the deposit due date, reservations are automatically

cancelled, and prices are always subject to change. Failure to remit final payments

on or before the final payment date will automatically put Your booking at risk of

cancellation and will result in a minimum $100 late fee. Bookings not paid within

seven (7) days of the final payment date will automatically cancel and all payments

will be forfeited, and You will be subject to our cancellation policy as set forth below

in the clause titled “Cancellation Policies”. Please contact Us immediately, and in

advance of Your payment due date, if You will be unable to meet this obligation.

Without limitation, Passenger(s) agree to voluntarily hold TRAVEL WITH WENDY B

harmless for cancellation of any booking for either late payment or declination of a

credit card. Payments are only accepted through Our online payment system.

Payments are never automatic unless pre-authorized through Our system. We

cannot take phone payments, checks, bank transfers or any other method of

payment.

While Our Suppliers do accept major credit cards including Visa, Mastercard,

American Express and Discover, Passenger(s) must provide to Us a signed or click

credit card charge authorization agreement for every transaction for Your trip. Your

authorization is a binding agreement for Us to charge Your card and an

acknowledgement and agreement to these Terms and Conditions including the

cancellation terms. As such, You agree not to make any improper chargebacks.

In certain cases, You have the ability to dispute charges with credit card companies

(“chargebacks”). Before initiating a chargeback, We ask You first to call Us to discuss

any questions or concerns about any charge. We will work with You in attempting

to resolve Your concerns. By using our service to make a reservation, You accept

and agree to our cancellation policy. TRAVEL WITH WENDY B retains the right to

dispute any chargeback that is improper and recover any costs, including attorneys’

fees related to improper chargebacks. Additionally, in the event of an improper

chargeback, We retain the right to cancel any travel reservation related to that

improper chargeback. The following chargeback scenarios are improper, and We

retain the right to investigate and rebut any such chargeback claims:

    Chargebacks resulting from non-cancellable reservations, whether or not the

reservation is used.

Chargebacks resulting from charges authorized by family, friends, associates

or other third parties with direct access to Your credit card. This does not

include credit card fraud.

Chargebacks arising from inconsistency or inaccuracy with regard to the

supplier’s product description.

Chargebacks resulting from force majeure or other circumstances that are

beyond the control of TRAVEL WITH WENDY B or the supplier.

Chargebacks resulting because You do not agree with the cancellation policy.

PRICING. The price listed on your quote, itinerary, or on our website is based on

known costs at the date of issue of the itinerary, quote or posting to Our website.

All prices we advertise are accurate at the date published, subject to any

unintentional errors, but we reserve the right to change any of those prices at any

time. Pricing and availability may change without notice. TRAVEL WITH WENDY B

reserves the right to charge Passenger(s) for any increase in taxes, fees, or

surcharges (i.e., fuel). Passenger(s) acknowledge this right and agree to pay any

such additional taxes, fees, and surcharges assessed by the Supplier(s). At the time

of booking confirmation, we will provide you with information on the current

pricing and particular inclusions. Prices and availability quoted by TRAVEL WITH

WENDY B are never guaranteed until deposit is fully paid, and even then, pricing is

still subject to change based on local taxes and fees that may change prior to your

travel. Passenger(s) agrees that TRAVEL WITH WENDY B is not responsible for any

errors or omissions in any quotes, advertisements, including on Our website,

resulting in inventory, content, or pricing discrepancies nor is TRAVEL WITH WENDY

B responsible for any errors or omissions that may occur as a result of incorrect

information from third parties or Suppliers. Suppliers reserve the right not to honor

any published prices that it determines were in error. You acknowledge this right

and agree to hold TRAVEL WITH WENDY B harmless for any actions or damages

arising from Supplier pricing.

REVISION POLICIES. Any change made to an itinerary or a reservation once

finalized will incur a minimum non-refundable $100 per person Revision Fee in

addition to any increase in trip cost. All revision requests must be in writing and

sent to Your TRAVEL WITH WENDY B agent by email. Your revision will be confirmed

via email if, and when it is processed. Revisions are based on availability, subject to

Supplier approval and are not guaranteed. Since changes may be considered

cancelled services, additional cancellation penalties may apply from any Supplier(s).

Changes are always subject to additional Supplier charges and are always based on

availability. Changes to airfare are subject to the air carrier’s terms and conditions.

CANCELLATION POLICIES. All cancellations are subject to a $150 PER PERSON

cancellation fee to TRAVEL WITH WENDY B in addition to any applicable Supplier

cancellation fees. All Suppliers have their own cancellation policies, which apply to

Your booking. If You are ever curious about the Supplier’s cancellation policies,

please refer to the Supplier’s terms and conditions, or inquire with Us prior to

booking with Us. Should a cancellation become necessary, please inform Your

TRAVEL WITH WENDY B agent immediately in writing by email and request a written

confirmation of Your cancellation. If You are entitled to a refund, please note that

the supplier is responsible for this refund, not TRAVEL WITH WENDY B. Generally,

flight tickets, hotel reservation and other items provided for the travel cannot be

refunded. We are not responsible for a Supplier’s failure to pay a refund, or for

supplier bankruptcy or insolvency.

If the reason for Your cancellation is covered under the terms of Your travel

protection insurance plan, You may be able to reclaim these charges, for this

reason we strongly encourage the purchase of a travel protection plan

including additional cancel for any reason coverage.

REFUND POLICY. All deposits and payments, including Our planning fee, made to

or through TRAVEL WITH WENDY B are non-refundable. TRAVEL WITH WENDY B is

required to pay all suppliers well in advance of Your trip date. Because We strictly

adhere to Our cancellation and refund policy, Travel Protection/Insurance is

strongly encouraged. If Travel Protection/Insurance has been declined, there are no

refunds for changes or cancellations and TRAVEL WITH WENDY B will have no

further liability to You. If Travel Protection/Insurance has been purchased, refunds

are subject to the insurance policy and subject to a minimum non-refundable $100

per person fee imposed by TRAVEL WITH WENDY B.

TRAVEL WITH WENDY B shall not offer or provide refunds for any unused portion of

any travel booking with Us. If you cancel while Your trip is in progress, there is no

refund for the unused portion (or any portion of your travel).

TRAVEL PROTECTION/INSURANCE. Travel Protection/Insurance is strongly

recommended. As Your travel agent, We have a professional responsibility to

recommend the purchase of Travel Protection/Insurance to protect both You and

Your vacation. Such a plan, at a minimum, should cover Trip Cancellation or

Interruption, Cancel for Any Reason, Medical Expense, Emergency

Evacuation/Repatriation, and Baggage. Travel Protection/Insurance plans can help

protect You in the event of loss of non-refundable trip deposits and payments that

result from cancellation or trip interruption (due to a covered reason such as injury

or illness before or during the trip) and can also help with reimbursement for

medical emergency costs (including very costly medical evacuation costs), missed

connections and baggage loss. While We may be able to offer some coverage

through the tour operator/supplier We use to book Your trip, there are other third-

party insurance providers for You to consult with. This responsibility rests solely

with each Passenger and We advise You to do Your research and find coverage that

best fits Your individual needs. TRAVEL WITH WENDY B is limited to advising You of

the need for such coverage and is not qualified to answer technical questions about

the benefits, exclusions, and conditions of travel protection/insurance plans.

TRAVEL WITH WENDY B cannot evaluate the adequacy of the prospective insured’s

existing insurance coverage. If You have any questions about Your Travel

Protection/Insurance, please call Your insurer or insurance agent or broker. All

claims must be filed with the insurance provider by You and are reviewed,

accepted, or declined at the sole decision and discretion of the insurance provider

and not TRAVEL WITH WENDY B.

Certain countries have a requirement for foreign visitors to have valid medical

insurance on entry. TRAVEL WITH WENDY B cannot be held responsible for denied

entry if any Passenger(s) is unable to provide details to authorities of insurance or

denial of entry for any reason. Declining travel protection/insurance plan coverage

could result in the loss of Your travel cost and/or require more money to correct

the situation. You also acknowledge that without this coverage, there may be no

way to recoup any losses, costs or expenses incurred. If You choose to travel

without adequate coverage, We will not be liable for any of Your losses

howsoever arising, for which travel protection plan coverage would otherwise

have been available.

CHANGES AND CANCELLATION BY THE SUPPLIER. We will inform You as soon as

reasonably possible if a Supplier needs to make a significant change to Your

confirmed booking or to cancel. We will also liaise between You and the supplier in

relation to any alternative arrangements offered by the operator, but We will have

no further liability to You.If between the initial planning stages and/or during your actual travel,

circumstances require changes, TRAVEL WITH WENDY B and the Suppliers, reserve

the right to cancel or vary any itinerary and substitute travel components of any

travel plans, including, but not limited to hotels and accommodations of

comparable quality, if air schedule or surface transportation changes, security

matters, and/or other events make such alterations necessary. Suppliers may

substitute transportation equipment depending on a variety of factors, including

the volume of passengers traveling, or availability. During local or national holidays,

certain facilities such as museums, sightseeing trips and shopping may be limited

or unavailable. In such instances itinerary changes are made by suppliers seeking to

reduce inconvenience to Travelers. Such changes are deemed not to be a major

change, and no compensation will be payable to Travelers. Holidays, closing days

and other circumstances may necessitate a change of the day of the week for

scheduled regional meals, sightseeing or other activities. If You feel Your enjoyment

might be diminished by any of these circumstances, please check with the

respective national tourist office before selecting a specific departure date.

FORCE MAJEURE.TRAVEL WITH WENDY B assumes no liability for, any loss, damage,

delay, or cancellation resulting in whole or in part from an Act of God or any other

force majeure condition, including, without limitation: fire, volcanic eruption,

hurricane, environmental pollution or contamination, inclement weather,

earthquake, low or high water levels, flood, water or power shortages or failures,

tropical storms or hurricanes, riots or civil commissions or disturbances, and any

other acts of a similar nature, sabotage, arrests, strikes or labor disruptions,

restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection,

quarantine restrictions, government health advisories, epidemics, pandemics, or

warnings or alerts of any kind of nature, government seizures, refusal or

cancellation or suspension or delay of any government authority or any license,

permit or authorization, damages to its facilities or the travel supplier and its

facilities, or any other unforeseen circumstances or any other factors unforeseen

by TRAVEL WITH WENDY B that impacts negatively on, or hampers, its ability to

fulfill any of its contractual conditions. In the circumstances amounting to force

majeure, We will not be required to refund any money to You, although if We can

recover any monies from Our Suppliers, We will refund these to You without any

charge by TRAVEL WITH WENDY B.

ASSUMPTION OF RISK & WAIVER. Traveler is aware that travel to some areas as

traveler is undertaking may involve inherent risks, some in more remote areas of

the world. Inherent risks include, but are not limited to, risk of injury or death from:

motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or

terrorist acts, government actions, consumption of alcoholic beverages, tainted

food, or non-potable water; exposure to the elements, including heat, cold, sun,

water, and wind; exposure to inherent risks in riding on theme park attractions,

your own negligence and/or the negligence of others, including tour guides, other

travelers; attack by or encounter with insects, reptiles, and/or animals; accidents or

illness occurring in remote places where there are no available medical services;

fatigue, chill, overheating, and/or dizziness, known or unknown medical conditions,

physical excursion for which you are not prepared or other such accidents; the

negligence or lack of adequate training of any third-party providers who seek to

assist with medical or other help either before or after injuries have occurred;

accident or illness without access to means of rapid evacuation or availability of

medical supplies or services; and the adequacy of medical attention once provided.

Traveler understands the description of these risks is not complete and that

unknown or unanticipated risks may result in injury, illness, or death. In order to

partake of the enjoyment and excitement of booked travel, traveler is willing to

accept the risks and uncertainty involved as being an integral part of travel,

including the risk of infection, illness, and death. TRAVELER HEREBY ACCEPTS AND

ASSUMES FULL RESPONSIBILITY FOR ANY AND ALL RISKS OF ILLNESS, INJURY OR

DEATH AND OF THE NEGLIGENCE OF TRAVEL WITH WENDY B AND AGREES TO AND

SHALL HOLD HARMLESS AND FULLY RELEASE TRAVEL BY WENDY B, AND ITS

REPRESENTATIVES FROM ANY AND ALL CLAIMS ASSOCIATED WITH YOUR TRAVEL,

INCLUDING ANY CLAIMS OF THIRD PARTY NEGLIGENCE AND/OR THE NEGLIGENCE

OF TRAVEL WITH WENDY B AND/OR ITS REPRESENTATIVES, AND TRAVELER HEREBY

COVENANTS NOT TO SUE TRAVEL WITH WENDY B AND/OR ITS REPRESENTATIVES

FOR ANY SUCH CLAIMS OR JOIN ANY LAWSUIT OR ACTION THAT IS SUING TRAVEL

WITH WENDY B. THIS AGREEMENT ALSO BINDS YOUR HEIRS, LEGAL

REPRESENTATIVES, AND ASSIGNS. THE TERMS OF THIS HOLD HARMLESS AND

RELEASE OF ALL LIABILITY PARAGRAPH, SHALL SURVIVE ANY TERMINATION OR

CANCELLATION OF THESE AGREED UPON TERMS AND CONDITIONS, WHETHER BY

OPERATION OF LAW OR OTHERWISE.

for damages or losses that result from travel to such destinations.

It is essential that You see Your physician before booking Your trip and before

traveling to make sure that You have taken all necessary health precautions. Some

vaccinations require more than one visit with a period of weeks between injections.

You should visit Your physician at least 6 weeks before departure. For up-to-date

medical advice We strongly recommend that You visit the Centers for Disease

Control and Prevention (CDC) travelers’ health page:www.cdc.gov/travelor for non-

US citizens, Your country’s equivalent.

INDEMNIFICATION. Traveler agrees to and shall indemnify and hold harmless

TRAVEL WITH WENDY B and its Representatives from any expenses, losses,

liabilities, damages, judgments, settlements and costs (collectively, “damages”)

involved with or incurred by TRAVEL WITH WENDY B or its Representatives

(including, without limitation, reasonable attorneys’ fees and the advancement of

same) with respect to any claims, law suits, arbitrations, or other causes of action,

which result, directly or indirectly, from: (i) traveler’s breach or violation, or

threatened breach or violation, of this Contract and (ii) any damage caused by

traveler while participating in any tour or travel.

INSECTICIDE NOTICE. Travelers are encouraged to check the list of countries that

require airlines to treat the passenger cabin with insecticides prior to the flight or

while on the aircraft on the U.S. Department of Transportation’s Web site, as this

list is updated from time to time: http://www.dot.gov/office-policy/aviation-

policy/aircraft-disinsection-requirements.

HAZARDOUS MATERIALS. Federal law forbids the carriage of hazardous materials

aboard aircraft in your luggage or on your person. A violation can result in five

years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous

materials include explosives, compressed gases, flammable liquids and solids,

oxidizers, poisons, corrosives, and radioactive materials. Examples include Paints,

lighter fluid, fireworks, tear gases, oxygen bottles, and radioactive materials. There

are special exceptions for small quantities (up to 70 ounces total) of medicinal and

toilet articles carried in your luggage and certain smoking materials carried on your

AIRFARE.

Airline tickets are highly restrictive, non-refundable, and non-transferable.

Modification of passenger names, dates, times, routings, or departure/arrival

airports is at the sole discretion of the airline and, if permitted, will likely be subject

to a substantial change fee. Passenger(s) is responsible for any such fees. With

regard to the purchase of air tickets, TRAVEL WITH WENDY B acts simply as an

intermediary between You and the airline. Once You book a reservation, Your credit

card or debit card will be charged for the amount shown – regardless of whether or

not the reservation is used. Credit will not be given for any unused airline tickets

and cannot be used toward any future bookings.

All tickets will be issued for economy class unless otherwise specified. All travel will

be round-trip unless otherwise specified. Seat assignments are subject to the

airline’s policies and may not be able to be made until You are at the airport on the

day of departure. Airline tickets booked through TRAVEL WITH WENDY B may not

be eligible to earn frequent flyer miles. You agree to confirm all bookings with the

airline prior to the stated date of departure (TRAVEL WITH WENDY B recommends

confirming 72 hours and 24 hours prior).

TRAVEL WITH WENDY B’s responsibilities in respect to air travel are limited by the

relevant airline’s conditions of carriage. The airline fulfilling Your contract for

carriage may change from the airline mentioned by TRAVEL WITH WENDY B.

TRAVEL WITH WENDY B is not able to specify the type of aircraft to be used by any

airline. If an airline cancels or delays a flight, You must work directly with the airline

to ensure You arrive at Your destination on or ahead of time. TRAVEL WITH WENDY

B will not provide any refund for trips missed, in part or full.

Where a ticket is purchased and used in violation of the airline’s rules, TRAVEL WITH

WENDY B and the applicable air carrier have the right in their sole discretion to take

all actions permitted by law. Please review the airline’s policy located on their

website.

Each airline has its own policy regarding luggage. We recommend that You check

with Your airline ahead of time for any weight restrictions and additional charges

relating to checked baggage. Luggage fees are not included with Your travel

package. You will be responsible for paying to the airline any additional charges for

checked overweight baggage, including, but not limited to, golf bags and oversized

luggage. If You exceed the weight limit set by Your airline, and excess weight is

permitted, You must pay a supplement directly to the airline at the airport.

The airline is liable to You for the baggage You entrust to it only for the

compensation contemplated in the international conventions and relevant statutes.

In the event of damage, late forwarding, theft, or loss of luggage, You should

contact the airline and declare the damage, absence, or loss of Your personal

effects before leaving the airport, and then submit a declaration, attaching the

originals of the following documents: the travel ticket, the baggage check-in slip,

and the declaration.

Baggage and personal effects are at all times the sole responsibility of the

Passenger(s). Due to continual changes in airline baggage and seat selection

policies, it is suggested that you inquire with your airline’s website for up-to-date

fees and information. TRAVEL BY WENDY B is NOT responsible for additional fees

incurred for baggage and seating assignments.

DISCLAIMER. Your contract for airfare is with the air carrier, inclusive of domestic,

international and charter flights, and subject to its terms, conditions and policies

and we will not be liable for any fees or expenses, including without limitation,

change fees, cancellation fees or any other additional costs you incur with the air

carrier. For charter trips/flights, please be aware the charter operator can legally

change, with limited notice, departure times up to forty-eight (48) hours, and flights

advertised as non-stop may be changed to make intermediate stops. Suppliers can

substitute types of aircraft and even airlines and are generally not responsible for

baggage delays/losses and have very stiff cancellation penalties. In addition,

frequent flyer miles may or may not be accrued and advance seat assignments are

frequently not available. TRAVEL BY WENDY B is not responsible or liable for any

costs incurred with any changes resulting from any flights.

RE-CONFIRM YOUR FLIGHT. We advise you personally to re-confirm your flight

schedule within twenty-four (24) hours prior to departure with the airline directly in

case of any last-minute changes or delays. Most airlines allow you to check in online

twenty-four (24) hours prior to departure. It is recommended that you arrive at the

airport a minimum of two (2) hours prior to departure for domestic flights, and

three (3) hours for international flights.

TRAVEL WITH WENDY B strongly recommends that You obtain a Travel

Protection/Insurance policy covering the value of Your items. TRAVEL WITH WENDY

B is in no way liable for damages arising from or related to any airline timetable

changes, delays, cancellations, missed connections, mechanical problems,

inclement weather, seating assignments, lost/delayed baggage, screening, and

security delays, refused boarding, failure to check-in properly or failure to provide

acceptable identification.

ACCOMMODATIONS AND ACTIVITIES. Accommodations are defined as lodgings in

a dwelling or similar living quarters afforded to passengers including, but not

limited to, hotels, condos, quarters in cruise ships, motels, time shares,

campgrounds, and resorts.

Accommodation classifications – The number of stars attributed to the hotels and

other providers of accommodations quoted by TRAVEL WITH WENDY B correspond

to a classification established as a point of reference in accordance with local

standards in the host country. Please be advised that accommodations and the

“star” designations may vary from country to country. The comments We make in

our descriptions are based on Our knowledge of the establishments and the

comments We have received from customers. TRAVEL WITH WENDY B makes no

guarantee about the suitability or availability of accommodations, and if the

particular accommodations sought are unavailable, We will do Our best to reserve

comparable accommodations, if possible. However, You would bear any additional

costs for upgrading the room or property. We reserve the right, for technical

reasons, in cases of force majeure or actions by third parties, to replace the

planned hotel with accommodation of the same category offering equivalent

services. This would only be in exceptional circumstances and in such cases, We will

inform You as soon as We are aware of this necessity.

Taking possession of and vacating Your room – Policies regarding taking possession

of and vacating rooms often vary by hotel and/or country, so it is Your responsibility

to check with the hotel ahead of time to verify the relevant policies and times.

TRAVEL WITH WENDY B is not responsible for any charges and damages resulting

from Your failure to timely take possession or vacate Your room. Typical check in

time is 4pm and check out time is 12pm but varies based on the Supplier’s terms

and conditions. Early possession or late vacation of Your room may result in fees

charged by the hotel and are at the hotel’s sole discretion and paid entirely by You.

Types of room – Room classifications and amenities vary by hotel and/or country,

so it is Your responsibility to check with the hotel ahead of time to verify the specific

amenities offered at the time of Your stay. We do our best to keep You informed,

but TRAVEL WITH WENDY B makes no guarantee that its descriptions and

photographs are an exact representation of the particular rooms offered. Special

requests, such as bedding preferences and room location can be communicated to

the hotel prior to Your arrival, but these requests are up to the hotel to honor.

TRAVEL WITH WENDY B is in no way responsible for granting or confirming special

requests like this.

Activities offered during Your stay – An activity may not be appropriate for all ages

or for individuals with certain medical conditions or abilities. TRAVEL WITH WENDY

B may not be held liable in the event of an incident or accident which is due to a

lack of vigilance on Your part. It may happen that certain activities are no longer

provided for climatic reasons, in the event of force majeure, during a stay out of the

tourist season, or when the minimum number of participants required for

providing a given activity is not reached (examples: group sports, children’s clubs).

In the early or late season some activities may not be available, some of the

facilities (restaurant, swimming pool, etc.) may be closed, or maintenance work may

be in progress. As a general rule, entertainment and sports activities may vary in

frequency depending on how many people are staying at the time and on climatic

conditions. Particularly during the high season, it is possible that the number of

parasols, loungers, sports equipment, etc., are insufficient for the demand. The

opening hours of bars, restaurants, and clubs, etc., may be irregular and dependent

on the management of the establishment in question. You agree that TRAVEL WITH

WENDY B is not liable for activities unavailable due to any of the reasons listed

above.

You acknowledge that the use or enjoyment of an activity may be hazardous and

inherently risky, and, to the maximum extent permitted by law, TRAVEL WITH

WENDY B shall have no liability for any personal injury or death; lost, stolen,

damaged or destroyed property; or other liability arising out of or in connection

with the use and operation of the activity, and all actions or events occurring prior

to, during, at, or after the activity.

Infants – We ask parents travelling with infants to bring with them the appropriate

food for their child, as they may not be able to find it at their destination. You may

be asked to pay a charge, for example for provision of a cot and/or for heating baby

food and drinks. You should request this when making Your reservation, though We

cannot confirm the availability of such services.

Traveling with children – Notary permission documentation is required for all minor

children traveling with anyone other than both legal parents. It is the Passenger’s

sole responsibility to obtain and maintain notarized permissions for all minor

children who are not traveling with both parents.

Pregnant women – If You are pregnant or expecting at or around the time of your

planned travel, please inform Us prior to booking. Some Suppliers do not permit

travel past certain gestational periods for your safety and the safety of your

child/ren. If You become pregnant after booking with Us, please consult with a

doctor and review the Supplier terms and conditions as they relate to your booking

to determine whether You will be permitted or prevented from traveling. If You are

denied boarding, embarkation, or access to a Supplier, Travel Product, or service

due to pregnancy, TRAVEL WITH WENDY B shall not be liable for any losses,

expenses, or refunds resulting from such loss of access for You or anyone traveling

with You.

Passengers with special needs or disabilities – It is essential that You advise us

before booking if You do have any disability or pre-existing medical condition which

may affect You r travel plans, or if You have any special requirements as a result of

any disability or medical condition (including any which affect the booking process)

so that we can assist You in considering the suitability of the arrangements and/or in

making the booking. TRAVEL WITH WENDY B will communicate requests to

Suppliers but cannot be responsible if ADA accommodations are not available. Any

accommodations provided will be at the sole expense of the traveler requiring the

accommodation. Please note that accommodations outside of the USA may not be

in compliance with the Americans with Disabilities Act and may not have wheelchair

accessibility.

Our Suppliers are, unfortunately, are unable to offer additional assistance to

travelers with limited mobility and all such assistance will need to be provided by

whoever the traveler is traveling with. Travelers with disabilities must notify TRAVEL

WITH WENDY B at the time of booking of status and of the identity of their non-

discounted, paid travel companion who will be responsible for providing all

necessary assistance. We may request that you provide a letter from your doctor

confirming your fitness to travel.

YOUR CONDUCT. Each Passenger is expected to act responsibly and adhere to all

behavior guidelines established by Our local suppliers. We and Our local suppliers

reserve the right to remove You from any trip if You endanger Yourself or others. In

any such case, there will be no refund.

When You book with TRAVEL WITH WENDY B, You accept responsibility for any

damage or loss caused by You. Full payment for any such damage or loss

(reasonably estimated if not precisely known) must be paid direct at the time to the

accommodation owner or manager or other supplier. You must indemnify us for

the full amount of any claim (also including legal costs) made against us. TRAVEL

WITH WENDY B is not responsible for any costs incurred concerning a Passenger

removed from a vacation/holiday. Passengers agree not to hold TRAVEL WITH

WENDY B or any of its related entities liable for any actions taken under these

terms and conditions.

ELECTRONIC COMMUNICATIONS. You have a committed agent by Your side every

step of the way. From check-in to check-out, You will have direct access to the

TRAVEL WITH WENDY B for Us to handle anything You may need assistance with

remotely while you are traveling. You can expect us to check in with You via email

and/ or text message before, during, and after Your travel or tour to ensure

everything runs smoothly. You consent to receive electronic communications from

Us, and You agree that all documents, notices, disclosures, and other communications

that We provide to you electronically, via email or through text,

satisfy any legal requirement that such communications be in writing.

NON-DISPARAGEMENT. TRAVEL WITH WENDY B encourages Our clients to provide

Us feedback on Our services along with Our suppliers’ services. Clients accepting

these Terms and Conditions and Our services agree that they will not disparage the

company or any of its agents, officers. directors, or employees. For purposes of this

Section, “disparage” shall mean any negative statement, review, report or ranking,

whether written or oral, about TRAVEL WITH WENDY B and its companies,

employees, officers, directors. Such actions as stated are in breach of this non-

disparagement agreement and entitles TRAVEL WITH WENDY B to seek

compensation for damages in the amount of $50,000 per instance.

CLASS ACTION WAIVER & LIMITATION OF DAMAGES. YOU AGREE THAT YOU WILL

ONLY BRING CLAIMS AGAINST TRAVEL WITH WENDY B IN YOUR INDIVIDUAL

CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS

ACTION OR REPRESENTATIVE PROCEEDING. TRAVEL WITH WENDY B SHALL NOT IN

ANY CASE BE LIABLE FOR OTHER THAN COMPENSATORY DAMAGES, AND YOUR

PAYMENT OF A DEPOSIT ON TRAVEL, A TRIP OR A TOUR MEANS THAT YOU AGREE

TO THESE CONDITIONS OF SALE AND EXPRESSLY WAIVE ANY RIGHT TO PUNITIVE

DAMAGES. YOU FURTHER AGREE THAT ANY RECOVERY YOU DO RECEIVE SHALL BE

SOLELY LIMITED TO THE AMOUNT TRAVEL WITH WENDY B EARNED IN

COMMISSION AND/OR FEES FROM YOUR BOOKING.

GOVERNING LAW & VENUE. These Terms and Conditions shall be governed by and

construed in accordance with the laws of the State of Illinois without regard to

conflict of law principles. Any claims shall be brought in a court of competent

jurisdiction located in Cook County, Illinois.

JURY WAIVER & NOTICE OF CLAIM. YOU HEREBY AGREE TO WAIVE YOUR RIGHT TO

TRIAL BY JURY. . YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE

CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST TRAVEL WITH

WENDY B UNLESS YOU HAVE FIRST PROVIDED A WRITTEN NOTICE OF CLAIM

RECEIVED BY TRAVEL WITH WENDY B NO LATER THAN THIRTY (30) DAYS AFTER

THE COMPLETION OF THE TRAVEL WITH WENDY B TRIP. PASSENGER CLAIMS

NOT SUBMITTED AND RECEIVED WITHIN THIS TIME SHALL BE DEEMED WAIVED

AND BARRED.PHOTOGRAPHIC/VIDEO LIKENESS AND FEEDBACK. Passenger(s) hereby give

consent and grants to TRAVEL WITH WENDY B a royalty-free, perpetual, and

irrevocable license to publish any testimonials, reviews, photographs and/or videos

of the trip or traveler in any form of media without obtaining further consent and

without compensation, solely for the purposes of marketing our trips. Each

passenger releases TRAVEL BY WENDY B and its Representatives from any liability

in connection with any use of such photographs and/or video. Notwithstanding the

foregoing, if a passenger desires to have a specific photo or video removed from

our website or social media, please request said removal per the email below.

ENTIRE AGREEMENT & SEVERABILITY. These Terms and Conditions, including any

other documents, itineraries, and invoices we provide You, constitutes Our entire

agreement and it supersedes all prior or contemporaneous communications and

proposals, whether electronic, oral, or written, with respect to TRAVEL WITH WENDY

B. If any provision of these Terms and Conditions shall be unlawful, void, or for any

reason unenforceable, then that provision shall be deemed severable from these

Terms and Conditions and shall not affect the validity and enforceability of any

remaining provisions. Failure by us to exercise or enforce any right or provision of

these legally binding Terms and Conditions shall not constitute a waiver of such

right or provision. Any ambiguities in the interpretation of these Terms and

Conditions shall not be construed against the drafting party. The provisions of

these Terms and Conditions which by their nature extend beyond termination or

expiration of these Terms and Conditions (whether by operation of law or

otherwise) shall survive the expiration or termination of these Terms and

Conditions to the full extent necessary for their enforcement and for the protection

of the party in whose favor they operate. If any provision of these Terms and

Conditions shall be held unenforceable, such provision shall be struck and the

remainder shall remain enforceable.
